These Terms and Conditions ("Terms") are an agreement between you and Nuchev Practitioner Pty Ltd (ABN 59 095 359 354), which operates the BioPractica brand and the website at biopractica.com.au ("we", "us", "our"). They govern your access to and use of our website, including any mobile, social, and online ordering services ("the Website"). By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.
1. Practitioner Only access
BioPractica supplies Practitioner Only products. Browsing general pages of the Website is open to the public, but the ability to view clinical and technical information, hold an account, and place orders is restricted to approved healthcare practitioners.
To purchase, you must hold an approved BioPractica account and agree to our Practitioner Partnership and Supply Policy. Approval is granted at our discretion and may require evidence of your qualifications, professional association membership, and current insurance. We may decline, suspend, or close access where eligibility is not met or where our policies are not followed.
2. Acceptance of terms
Your access to and use of the Website confirms your acceptance of these Terms, our Privacy Policy, our Practitioner Partnership and Supply Policy, and all applicable laws.
3. Intellectual property
All trademarks, logos, names, images, product information, and other content on the Website ("Content") are owned or licensed by Nuchev Practitioner Pty Ltd and protected under Australian and international law. You may not copy, reproduce, modify, republish, or distribute any Content without our written permission. Approved practitioners are granted a limited licence to use approved logos, product images, and recommended retail pricing on their own public-facing pages, strictly in line with our Practitioner Partnership and Supply Policy.
4. Accounts and security
When you register for a Website account, you agree to provide accurate and current information and to keep your login details confidential. You are responsible for all activity that occurs under your account. Tell us immediately if you become aware of any unauthorised access.
5. Privacy and electronic communications
We collect and handle your personal information in line with our Privacy Policy and the Privacy Act 1988 (Cth). Our Privacy Policy is available at biopractica.com.au/pages/privacy-policy.
By using the Website, you agree to receive electronic communications from us about your account, orders, and legal notices. You can opt out of promotional emails at any time using the unsubscribe link in those emails or by contacting us at custserv@nuchev.com.au.
6. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any right or guarantee you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot lawfully be excluded. You are entitled to goods that are of acceptable quality, fit for their purpose, and match their description. More information is available at accc.gov.au.
Where the products are acquired for the purpose of onsupply to patients, and to the extent permitted by law, our liability for a failure to comply with a consumer guarantee may be limited to replacing the goods, supplying equivalent goods, or paying the cost of doing so.
7. Orders, pricing, and payment
Prices are shown in Australian dollars. Wholesale prices are exclusive of GST, and GST is applied at checkout where it applies. Recommended retail pricing, where shown, is GST inclusive.
Orders are subject to product availability and to account approval. Payment is made in full at checkout by credit or debit card. We may cancel or refuse any order, including where we suspect misuse, incorrect details, or a breach of our policies. Promotional offers may change without notice.
8. Supply conditions and onsupply to patients
BioPractica products are Practitioner Only and are supplied for use within a practitioner-led clinical relationship. As an account holder, you agree that products purchased through the Website will be supplied to patients only in line with our Practitioner Partnership and Supply Policy. In particular, you must not supply products to unqualified persons, make them available for public self-selection, or treat them as general retail items.
Where you order for direct delivery to a patient through the Website, the clinical conversation and your clinical oversight must still occur before the order is placed.
9. Delivery and risk
Orders are dispatched using our nominated carrier. Delivery times are estimates only. Title and risk in the goods pass to you on delivery, following payment in full at checkout. You are responsible for providing correct and complete delivery details, and for any redelivery costs where an address is incorrect or delivery is unattended. We are not liable for delays or failed deliveries caused by factors outside our reasonable control.
10. Short-dated stock
From time to time we may offer short-dated products, meaning products approaching their expiry date. Short-dated products are clearly identified before purchase. By placing an order for a short-dated product, you accept its stated expiry date. Short-dated products are not returnable other than for a genuine quality issue or as required under the Australian Consumer Law.
11. Temperature-sensitive and refrigerated goods
Some products, including probiotics, are temperature sensitive. We pack these with appropriate insulation, but we use standard, non-refrigerated carriers, and we cannot guarantee the temperature of goods in transit.
You order temperature-sensitive goods at your own risk. We recommend you avoid ordering these products in periods of extreme heat, avoid ordering late in the week where a weekend delay is likely, and consider arranging collection or an alternative for such orders. To the extent permitted by law, we do not accept liability, and do not offer credits or refunds, for temperature-sensitive goods that arrive warm, other than where required under the Australian Consumer Law.
12. Returns and refunds
Your rights under the Australian Consumer Law always apply. Where goods are faulty, not of acceptable quality, or not as described, we will provide a remedy as required by law, at no cost to you.
We accept returns and exchanges only for products with a genuine quality issue, meaning manufacturing faults, products that arrive damaged, products supplied incorrectly, or products that do not meet our published specification. We do not accept change-of-mind returns or product swaps.
For quality-issue returns, the following applies:
- Contact us at custserv@nuchev.com.au within 14 days of the despatch date, with your order number and a photo of the product or issue.
- All returns must be authorised by us before goods are sent back. Items sent back without authorisation will not be accepted.
- We will arrange a replacement or refund and, where appropriate, organise return shipping at our cost.
- We may refuse goods returned soiled, contaminated, expired, or not in a condition that allows us to assess the issue.
- Discontinued and clearance items are not eligible for return, except where they have a genuine quality issue or where required under the Australian Consumer Law.
- Approved refunds are made to the original payment method within 10 business days. Your bank or card provider may take additional time to post the refund.

13. Order accuracy and cancellations
Please check your order carefully. Any discrepancy between an order and what you received must be raised with us within five business days of the invoice date.
You may cancel an order at no charge at any time before it has been dispatched from our warehouse. Once an order has been dispatched, it is treated as a return under clause 12.
14. Reviews and submitted content
If you submit content to the Website, such as a review or testimonial, you grant us a non-exclusive, royalty-free licence to use, edit, and share that content in connection with our business. You are responsible for the content you submit, and we may remove or restrict it at our discretion. Any clinical or product claims in submitted content must comply with the Therapeutic Goods Advertising Code.
15. Prohibited conduct
You agree not to:
- Post unlawful, harmful, defamatory, or misleading content
- Upload viruses or malicious code
- Use the Website to harass or abuse others
- Infringe any intellectual property rights
- Interfere with the proper functioning of the Website
- Attempt to access practitioner-only areas without an approved account
16. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss arising from your use of the Website. Where our liability cannot be excluded, it is limited to the amount you paid for the relevant goods or services. Nothing in this clause limits any right you have under the Australian Consumer Law that cannot lawfully be excluded.
17. Events outside our control
We are not liable for any delay or failure to perform our obligations caused by events outside our reasonable control, including natural disasters, extreme weather, fire, pandemic, industrial action, carrier or supplier failure, utility or communications outages, or government action.
18. Termination
We may suspend or end your access to the Website at any time for a breach of these Terms or our policies. You may stop using the Website at any time.
19. General
If any part of these Terms is found to be invalid or unenforceable, that part is severed and the rest of the Terms continue to apply. If we do not enforce a right on one occasion, that is not a waiver of that right on any later occasion. We may transfer our rights and obligations under these Terms; you may not transfer yours without our written consent. Notices under these Terms must be in writing and may be sent by post or email.
20. Governing law
These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria.
21. Changes to these terms
We may update these Terms from time to time. The current version will always be available on the Website, and your continued use after a change means you accept the updated Terms.
